La r\u00e9ponse de Benjamin Horand, responsable du service AQ et MSST de la BCS.<\/p>\n\n\n\n<p>A la mi-octobre, l\u2019Office f\u00e9d\u00e9ral de la s\u00e9curit\u00e9 alimentaire et des affaires v\u00e9t\u00e9rinaires (OSAV) a publi\u00e9 trois lettres d\u2019information qui concernent notre production artisanale. L\u2019Association suisse des patrons boulangers-confiseurs (BCS) renvoie au chapitre sur la vente du Guide des bonnes pratiques qui traite des indications obligatoires pour la d\u00e9claration des aliments.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-declaration-reduite\">D\u00e9claration r\u00e9duite<\/h2>\n\n\n\n<p>Seuls les produits vendus dans les 24 heures peuvent faire l\u2019objet d\u2019une d\u00e9claration r\u00e9duite pour la vente en vrac.<br>La l\u00e9gislation sur les denr\u00e9es alimentaires entr\u00e9e en vigueur le 1er mai 2017 a introduit l\u2019obligation de faire figurer la d\u00e9claration nutritionnelle. En sont exempt\u00e9es les denr\u00e9es alimentaires mises sur le march\u00e9 en vrac. Par \u00ab denr\u00e9e alimentaire mise sur le march\u00e9 en vrac \u00bb, on entend aussi un aliment pr\u00e9emball\u00e9 en vue de sa remise imm\u00e9diate. Dans sa lettre d\u2019information de la mi-octobre (2019\/3.2), l\u2019OSAV a d\u00e9fini un d\u00e9lai de 24 heures pour lequel la remise imm\u00e9diate peut \u00eatre invoqu\u00e9e.<br>L\u2019exemple d\u2019une salade pr\u00eate \u00e0 l\u2019emploi y est cit\u00e9 : une salade toute pr\u00eate dans un take-away, si elle est pr\u00e9emball\u00e9e dans un emballage en plastique afin d\u2019\u00eatre remise imm\u00e9diatement (dans un d\u00e9lai de 24 heures) aux consommateurs, est consid\u00e9r\u00e9e comme mise sur le march\u00e9 en vrac. Si elle est conditionn\u00e9e dans un emballage sous atmosph\u00e8re protectrice dans l\u2019intention d\u2019\u00eatre remise plus de 24 heures apr\u00e8s son emballage, une salade toute pr\u00eate doit \u00eatre consid\u00e9r\u00e9e comme un aliment pr\u00e9emball\u00e9 et faire l\u2019objet d\u2019une d\u00e9claration compl\u00e8te.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-caractere-local-et-artisanal\">Caract\u00e8re local et artisanal<\/h2>\n\n\n\n<p>Les denr\u00e9es alimentaires de fabrication locale et artisanale, vendues dans un rayon de 50 km et sans interm\u00e9diaire, sont exempt\u00e9es de l\u2019obligation de d\u00e9claration nutritionnelle, rel\u00e8ve l\u2019OSAV, dans sa lettre d\u2019information de la mi-octobre (2019\/4.1).<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-alternatives-vegetaliennes-et-vegetariennes\">Alternatives v\u00e9g\u00e9taliennes et v\u00e9g\u00e9tariennes<\/h2>\n\n\n\n<p>L\u2019utilisation d\u2019une d\u00e9nomination sp\u00e9cifique d\u00e9finie pour les produits de substitution v\u00e9g\u00e9taliens ou v\u00e9g\u00e9tariens telle que \u00ab Je ne suis pas une saucisse \u00bb n\u2019est plus admise. La troisi\u00e8me Lettre d\u2019information du d\u00e9but juillet 2020 (2020\/3.1) de l\u2019OSAV pr\u00e9cise l\u2019\u00e9tiquetage des aliments v\u00e9g\u00e9taliens et v\u00e9g\u00e9tariens. Les all\u00e9gations n\u00e9gatives ne seront plus admises pour ces produits.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-declaration-vente-en-vrac\">D\u00e9claration vente en vrac<\/h2>\n\n\n\n<p>Les dispositions relatives \u00e0 la d\u00e9claration des denr\u00e9es alimentaires pr\u00e9emball\u00e9es s\u2019appliquent par analogie aux denr\u00e9es alimentaires mises sur le march\u00e9 en vrac. En principe, les m\u00eames informations obligatoires que pour les denr\u00e9es alimentaires pr\u00e9emball\u00e9es doivent \u00eatre d\u00e9clar\u00e9es. N\u00e9anmoins, on peut renoncer \u00e0 certaines indications \u00e9crites \u00e0 condition que le consommateur soit inform\u00e9 d\u2019une autre mani\u00e8re (par exemple oralement). Ces informations doivent \u00eatre fournies dans un d\u00e9lai de 5 minutes. Il convient d\u2019indiquer par \u00e9crit dans tous les cas l\u2019origine de la viande, le recours \u00e9ventuel au g\u00e9nie g\u00e9n\u00e9tique ou \u00e0 des proc\u00e9d\u00e9s technologiques particuliers durant la fabrication, et les informations pr\u00e9vues dans l\u2019ordonnance agricole sur la d\u00e9claration. Les informations orales sur les allerg\u00e8nes ne sont admises que si la possibilit\u00e9 d\u2019obtenir des renseignements oraux est affich\u00e9e.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-vente-en-ligne\">Vente en ligne<\/h2>\n\n\n\n<p>Dans un communiqu\u00e9 de presse publi\u00e9 en octobre, l\u2019Association des chimistes cantonaux de Suisse a d\u00e9plor\u00e9 les informations incompl\u00e8tes concernant les aliments dans le commerce en ligne. Dans environ 80 % des boutiques en ligne, les informations \u00e9taient insuffisantes ou totalement absentes. De fr\u00e9quentes lacunes ont \u00e9t\u00e9 constat\u00e9es dans l\u2019indication des ingr\u00e9dients allerg\u00e8nes et dans la liste des ingr\u00e9dients.<br>Dans le commerce en ligne les consommateurs doivent disposer des m\u00eames informations que celles qui doivent \u00eatre mises \u00e0 disposition lors de la remise sur place, imprim\u00e9es sur les denr\u00e9es alimentaires pr\u00e9emball\u00e9es ou donn\u00e9es oralement lors d\u2019un achat en magasin. Si les informations n\u2019apparaissent pas par \u00e9crit lors de la vente en ligne, elles doivent pouvoir \u00eatre obtenues \u00e0 tout moment, imm\u00e9diatement et gratuitement par d\u2019autres canaux (t\u00e9l\u00e9phone, chat, etc.).
