Les nouveaux salaires minimaux applicables \u00e0 partir de 2023 conform\u00e9ment aux r\u00e8glements salariaux ont \u00e9galement \u00e9t\u00e9 d\u00e9clar\u00e9s de force obligatoire.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-les-salaires-minimaux\">LES SALAIRES MINIMAUX<\/h2>\n\n\n\n<p>Pour distinguer les cat\u00e9gories salariales respectives I (travailleurs \u00ab non qualifi\u00e9s \u00bb) et II (travailleurs \u00ab qualifi\u00e9s \u00bb), seules les d\u00e9finitions de la CCT (art. 6a et 6b) sont d\u00e9terminantes.<br>Pour simplifier, est consid\u00e9r\u00e9e comme qualifi\u00e9e (et relevant de la cat\u00e9gorie salariale II) toute personne titulaire d\u2019un dipl\u00f4me professionnel et travaillant de mani\u00e8re cumulative dans la profession apprise. Un autre dipl\u00f4me professionnel, qui ne correspond pas au domaine d\u2019activit\u00e9 dans l\u2019entreprise, ne donne pas droit au salaire minimum pour personnes qualifi\u00e9es. Par exemple, un carrossier titulaire d\u2019un CFC travaillant dans la vente est consid\u00e9r\u00e9 comme un travailleur \u00ab non qualifi\u00e9 \u00bb (malgr\u00e9 son CFC), car il n\u2019exerce pas la profession apprise.<br>En cas de contr\u00f4le du livre de paie par la Commission paritaire boulangers-confiseurs, la liste des collaborateurs doit \u00eatre remplie en tenant compte de la distinction ci-dessus, faute de quoi des demandes de rappels de salaire excessifs peuvent en r\u00e9sulter.
